WORK ACCIDENT COMPENSATION - NO WIN NO FEE

Inadequately trained employees pose a major threat in the workplace. Employees are far more likely to make a potentially dangerous mistake and they are far less likely to be able to deal with the situation if they have not received proper training. British and EU law requires that employers ensure staff members are adequately trained to safely carry out their jobs. Furthermore there is a requirement for more junior staff to be adequately supervised in tasks that are at the limit of their knowledge, training and capability.

Inadequate Supervision & Training

Employers must ensure that new staff members are trained to carry out their duties safely. If an employee is injured performing tasks that they were inadequately trained to perform, they can sue the employer for compensation. In addition an employee injured by the actions of an improperly trained fellow employee can make a compensation claim against the employer who is responsible for the actions of their staff. In cases where proper accreditation is required to perform a specific job function, an employer is responsible for making sure that the employee performing this function has the required credentials.

Safety Equipment

The Personal Protective Equipment at Work Regulations 1992 also state that relevant employees must be provided with personal protection equipment and receive training on how to use that equipment as well as instruction on specific safety risks in that particular industry and how to best avoid personal injury.

Legal Right to Damages

Receiving proper training on hazards in the workplace and safe procedures is one of the basic rights of British employees.
