UK ROAD TRAFFIC ACCIDENT CLAIM

Motor collisions are a leading cause of death, casualties and human suffering. Every year over 3,500 people are killed on Britain’s roads and over 40,000 are subject to serious injuries. There are over 300,000 casualties in nearly 240,000 accidents which results in over 100,000 road traffic accident claim settlements every year. Over 90% of accidents are caused by driving errors of which alcohol, fatigue and excess speeding are major contributors. Driving whilst under the influence of alcohol is responsible for 15% of deaths and excess speed is a contributory factor in most accidents. One in every ten drivers and front seat passengers do not use seat belts or child restraints. Over 200 children, 600 motorcyclists, 130 pedal cyclists and 700 pedestrians are killed every year due to road accidents.

If you have been injured in an accident, within the last three years, that wasn’t your fault we can help you to make a road traffic accident claim to get the compensation you deserve. Even if you were a driver and the accident was partially your fault we may be able to get you a proportion of the damages that you would otherwise have received on a full liability basis. This concept is known as 'contributory negligence' and apportions liability on a percentage basis between the drivers involved in the accident. The blame for an accident may for example be judged to be 60/40 in favour of one of the drivers. In this case each driver would be awarded the relevant percentage of the damages that they would otherwise have been entitled too on a full liability basis. The claims for passengers are unaffected by these apportionments and passengers will usually receive their compensation in full even though it may have been 'their' driver who was wholly or partially at fault.

In general terms a road traffic accident claim for compensation for personal injury must either be settled or a summons must have been issued in a court of law within three years of the injury. The Limitation Act 1980 contains the relevant provisions however it is important to note that there are a number of exceptions to the general rules. If you are in any doubt about whether or not you are too late to claim you should urgently seek legal advice from a qualified UK lawyer.

Our solicitors are all members of The Law Society panel of personal injury experts and will deal with your case on a no win no fee basis.
