The scheme which is governed by a “Conditional Fee Agreement” (CFA) entered into between you and your no win no fee solicitor was first introduced in 1998 and replaced government funded Legal Aid for personal injury cases. Except in medical negligence claims, Legal Aid for personal injury is no longer available, and almost all accident cases are dealt with using a CFA.

The scheme operates by passing the risk of losing cases onto the lawyer. If the claim is lost the solicitor cannot claim any legal fees from anyone. He cannot bill the other side; he cannot claim legal fees from his client and as a result he just has to write off his time and effort. If the case is won, the solicitor claims his costs from the other side and does not charge his own client. Compensation is recovered in full and our lawyers pay compensation in full without making any deductions.

There are a number of variations allowed on CFA’s and some legal firms will charge the clients as the case proceeds, some charge for disbursements and some ‘claims management’ companies claim a percentage of the damages recovered. We are not a claims management company and we do none of this. Our clients do not have to put their hand in their pocket at any time and all compensation recovered is paid over in full.

The losing side in a legal case usually has to pay the wining side their legal costs. In the unlikely event of losing you case you could have a liability for the other sides costs however to remove this risk, all cases are insured against losing and our solicitors pay for this insurance without your involvement. Our no win no fee solicitor network actually succeeds in about 98% of our accident claims which is due to the experience and expertise of our solicitors who are able to manage risk successfully and advise you at an early stage as to whether or not you have a viable case. If after taking our advice you not to proceed to enter into a CFA, you are quite at liberty to do so, and you will not be charged anything at all for our advice.

Some clients do have a 'legal expenses' policy of insurance tagged on to other insurance such as home contents or motor insurance which covers them to take legal action and indemnifies them against having to pay legal fees.
