NO WIN NO FEE :: OCCUPATIONAL INURY COMPENSATION


No win no fee arrangements are formally based on conditional fee agreements (CFA) which were initiated in the UK to replace legal aid for personal injury claims. There are a lot of misconceptions regarding conditional fee agreements and more often than not the members of the general public have the preconceived notion that the client is not charged for anything at all. In fact, under a no win no fee agreement a solicitor is permitted to collect a legal fee from the client provided that the claim is successful and the claimant receives compensation. The current practice however is that most firms do not deduct anything from the compensation awarded to the client. Instead, they depend on the fact that the court will order the defendant or the defendant’s insurers to make full or part payment towards the legal costs of the claimant.

Before The Event Insurance - BTE

For claimants with insurance that covers legal expenses, there is usually no need to enter into a no win no fee agreement with their solicitors. This type of insurance is known as before the event (BTE) insurance and is often an ‘add on’ to policies of motor insurance and home insurance. BTE insurance usually covers all legal expenses for taking or defending legal claims, including the solicitors' fees. Before entering a no win no fee agreement with any solicitors firm, it is imperative that you check you insurance policies for BTE cover which takes precedence over a no win no fee agreement.

After The Event Insurance - ATE

Another matter that must be considered before taking any legal action is the fact that you may lose your case and be ordered to pay the defendants legal costs. In order to avoid such a problem, solicitors working under a no win no fee agreement will usually take out an insurance policy to cover any potential costs order.
