Pain & Suffering
The monetary award in a motor accident compensation claims comprises damages for financial losses both past and estimated for the future and an amount for the pain and suffering of any personal injury. Compensation for personal injury must be assessed by a Judge and is based on the extent of the injury, the time taken for recovery and the consequences of any long term disability. The amount of an award is determined on the basis of the Judges personal experience, consideration of previously decided cases and Government guidelines put forward by the Judicial Studies Board.

Contributory Negligence
Even if you were partly to blame for the accident you can still make a claim however the amount of compensation that is awarded may be reduced on the basis of the doctrine of ‘contributory negligence’. The judge will hear all of the evidence and in cases where both drivers were negligent will determine liability on a percentage basis thereby reducing the amount of compensation awarded to each driver on the basis of their share of liability for causing the accident. Clearly innocent passengers who are injured can never be to blame for an accident however they may be in a situation where each driver must contribute to payment of their damages if liability is shared between two or more drivers.

RTA Statistics
UK road traffic accidents number over 250,000 each year including almost 30,000 serious injuries with over 3,000 fatalities and over 200,000 less serious injuries. Certain elements of the population are most likely to be at risk, with over 600 pedestrians being killed annually, together with over 100 cyclists and over 500 motorcyclists. Young people are particularly prone to road traffic accidents illustrated by the fact that over 200 children are killed on the roads each year.
Car drivers aged 21 and under are involved in double the average number of car accident compensation claims. That the main cause is probably inexperience, illustrated by the fact that accident rates diminish as drivers become older. Young drivers under the age of 25 are more inclined than most to drive above the speed limit and also above the legal alcohol limit, however, it is male drivers above 30 years of age who are most likely to be found liable in car accident compensation claims alleging excessive speed as the main cause of a collision.
