INDUSTRIAL DEAFNESS COMPENSATION CLAIMS

Hearing loss caused by exposure to noise whilst at work is a serious occupational problem that has only been addressed properly in recent years. A loss of hearing at any age can severely impinge on daily activities including work and social relationships. Victims may find that they are unable to carry out their preferred occupations and that they become isolated when in their home environment. If you suffer from a hearing problem resulting from an adverse work environment you can issue legal proceedings against your negligent employer and claim occupational or industrial deafness compensation.

Ear Protection Essential

Regular exposure to noise level exceeding 90dB is likely to cause permanent impairment to hearing known as occupational deafness. Hearing problems can develop at lower sound levels if exposure is for a prolonged long time. A single extremely loud blast of noise is also sufficient to permanently damage hearing. Employers are required by law to provide adequate ear protection in noisy areas and to warn employees of the extent of the level of the noise by warning signs. Failure to carry out these legal requirements may mean that an employer is liable to pay industrial deafness compensation to any person that is injured due to neglect of the health and safety regulations.

Tinnitus & Occupational Deafness

Tinnitus which is another hearing problem can also develop due to a noisy workplace. A person with tinnitus commonly hears buzzing and whistling sounds that no else can hear. Tinnitus symptoms can be more than just annoying and may substantially affect hearing. Tinnitus is not to be taken lightly since it can and does affect victims’ lives significantly.

Employers Duty of Care

It is the duty of employers to take care of the health and safety of employees whilst they are in the workplace. An employer should ensure that noise is reduced so far as is reasonably practicable and when it is not possible to reach an acceptable noise level for any particular process they should provide adequate ear protection for employees and ensure that they do actually use the safety equipment provided.
