Not Necessary to Prove Negligence

Since the Consumer Protection Act 1987 came into force it is no longer necessary to prove a producer’s negligence in order to receive damages in a food poisoning compensation claim. It is only necessary that the claimant has been injured as a result of a defective product. UK safety regulations require that all food be safe for human consumption. A “defective” food product is defined as one in which, “the safety of the product is not such as persons generally are entitled to expect.”

Criminal Offence

The Food Safety Act 1990 states :-

    It is an offence to make dangerous produce intended to be sold for human consumption.

    It is an offence to supply produce for human consumption that is: dangerous to health, unfit for human consumption, contaminated or not of the acceptable nature, substance or quality demanded by the purchaser.

    It is an offence to falsely describe, advertise or present food for sale.

Millions Affected
