Award of Damages
The amount of compensatory damages awarded in defective product compensation claims as the result of personal injury is based on awards made in previously decided cases of a similar nature. Records of previous awards can be found in a multi-volume text book called “Kemp and Kemp” that can be found in most public libraries and solicitors’ offices. The goal of awarding damages is to return the injured party back to the same position that they would have had if there had been no injury.

Defective Product Compensation
Many factors are considered by a judge when deciding the amount of compensation to award in defective product compensation claims including the extent of the injury and associated pain and suffering together with the effect of any lasting or ongoing disability or injury. Actual amounts of the award are determined both by previous cases and appeals and by the judge’s own experiences, factoring in guidance from a Government publication called “The Judicial Studies Board Guidelines for the Assessment of General Damages in Personal Injury Cases”. This publication collates together many of the accepted norms of compensatory awards into one basic digest, though because injuries and damages in this area are so varied, every claim must be considered on its own specific set of circumstances.
