CRANE ACCIDENT COMPENSATION CLAIMS

Lifting equipment is generally extremely heavy and incidents can often be very serious and frequently involve fatalities. A crane accident compensation claim can result from a total collapse of the equipment which often involves the structural collapse of nearby buildings or can involve serious injuries and death by virtue of swinging loads or objects falling from height or can in rare circumstances involve a fall by the crane operator.

Negligent Operation - Collapse & Falls

Most incidents are caused by negligent planning and inadequate training and supervision in the operation of a crane. When a crane accident happens, both employers and/or crane operators can be held liable if either party did not follow the safety guidelines outlined in the Provision and Use of Work Equipment Regulations Act 1998 and the Lifting Operations and Lifting Equipment Regulations (LOLER) Act 1998. The LOLER Act was brought about in recognition of the danger of crane accidents and it outlines procedures that employers must follow, including ensuring that the crane is checked on a regular basis and that its use is planned in full and is carried out by competent trained people. Operators are also responsible for ensuring that they are operating their cranes safely and they can be held liable for crane accidents that happen because they did not properly check maximum load limits or left a load unattended etc.
