BIO MEDICAL DEVICES - MULTI PARTY & GROUP ACTIONS
“Bio-medical device” is a term that covers a variety of medical equipment, both internal and external, for either cosmetic or health reasons. This term can apply to prosthetic implants, breast implants, pacemakers, internal contraceptives, artificial heart valves, replacement hips and more. External devices, such as wheelchairs, respiratory equipment and more, are also considered bio-medical devices.

Consumer Protection UK
Since the Consumer Protection Act 1987, it is no longer necessary that a claimant prove a manufacturer’s negligence in order to receive compensatory damages for injury resulting from their products. This Act applies to all products first available after the first of March, 1988. Statutes involving this topic throughout the UK are :-
Scotland - the Consumer Protection Act 1987 (Product Liability) (Modification) (Scotland) Order 2001 (Statutory Instrument 2001 No. 265)
England and Wales - the Consumer Protection Act 1987 (Product Liability) (Modification) Order 2000 (Statutory Instrument 2000 No. 2771)
Northern Ireland - the Product Liability (Amendment) Act (Northern Ireland) 2001

Legal Aid & No Win No Fee
Funding a multiparty action can be extremely expensive however legal aid may be available in certain circumstances and solicitors will consider a no win no fee arrangement as a means of financing certain personal injury compensation claims. Clients can of course pay privately and there is always the possibility of funding from a trades union or cover under a policy of insurance but these latter three methods must be considered as unlikely scenarios.

Multi Party Action – Group Action
If a group of people has similar claims arising from the same bio-medical device, a “multi-party” type of claim may be an appropriate alternative to an individual suit. This allows individuals to pool their information and resources together for a more efficient and cost-effective compensatory resolution.
