MINERS KNEE MENISCI CARTILAGE DAMAGE CLAIMS


The South Wales Argus has launched a long overdue campaign to attempt to get justice for those industrial workers, mainly retired coal miners, who suffer from knee damage. There are potentially tens of thousands of potential compensation claims for knee osteoarthritis and damage to the menisci cartilage tissue with over 5,000 miners in South Wales alone and many more in other areas of the country suffering from this crippling injury to the knee which is caused by years of working underground, crouching and kneeling to cut coal at the cramped coal faces. Many ex-miners are now unable to walk properly due to the severe pain of knee osteoarthritis and damage to the menisci cartilage tissue. There have been a number of successful individual cases in the courts and NACODS and the NUM unions are involved in a test case claiming compensation for miners with crippled knees in the Leeds court against the Department of Trade and Industry. This case relates to knee osteoarthritis and damage to the menisci cartilage tissue excluding knee bursitis.

    "The prolonged kneeling, crouching and squatting in coal pits that many miners had to endure has led to thousands suffering from serious knee injuries, and is the cause of chronic and debilitating conditions like osteoarthritis."

Repetitive Strain Injuries

Miners knee osteoarthritis and damage to the menisci cartilage tissue result from a repetitive strain injury caused by overloading of the joints. There have been several successful miners knee injury claims in the courts which have relied on the existing law that requires employers to take reasonable care of their employees. There is now copious legislation to protect employees from misdeeds, negligence and carelessness by employers who must, by law, take reasonable care for the health and safety of those who work for them.

Strict Liability

There are circumstances where an employer is under an absolute duty of care to protect employees from harm and even though an employer has not been negligent and has done all he can to care for the safety of staff, the employer can nevertheless still be held liable and damages awards can be made in favour of the employee in a court of law. All employers are required to provide adequate equipment and a safe system of work with proper training and supervision and if he does not do so and personal injury occurs then the employer may be liable to pay compensation to the employee.
