ASBESTOSIS & MESOTHELIOMA COMPENSATION CLAIMS

Asbestos related disease which encompasses asbestosis, mesothelioma and pleural plaques occurs as a result of inhalation of asbestos fibres which occur naturally in certain groups of minerals used in the manufacture of various products mainly for the building and construction trade. Four types of this material have been used commercially in the past :-

  • chrysotile (white asbestos)
  • crocidolite (blue asbestos)
  • amosite (brown fibres)
  • anthophyllite (grey fibres)

Asbestosis - Mesothelioma - Pleural Plaques

Asbestos in the form of chrysotile, crocidolite, amosite and anthophyllite were commonly used in construction, building and shipbuilding and those most in danger of contracting asbestosis, mesothelioma or pleural plaques will have suffered prolonged exposure to one or more of these materials. Dangerous occupations include demolition and construction workers, those involved in insulation or workers in asbestos product manufacturing factories. It should however be noted that prolonged exposure is not necessary for a person to develop either asbestosis or mesothelioma and even minimal exposure can result in an asbestos related disease.

Asbestosis

Asbestosis is caused by exposure to asbestos fibres and is a chronic inflammatory condition of the lung characterised by shortness of breath which may lead to respiratory failure and death. The presence of asbestosis leads to an increased risk of lung cancer and an increased risk of mesothelioma which is an asbestos related cancer. A cough is not a typical symptom of asbestosis. The presence of asbestos fibres in the lungs causes long term scarring of the lung tissue thereby reducing effective transfer of oxygen resulting in shortness of breath. Asbestosis may not become apparent until decades after exposure although most cases become apparent 5- 10 years after exposure.

Mesothelioma

One of the most serious asbestos related diseases is mesothelioma which is a cancer of the protective lining found in the abdomen and chest called the mesothelium. Chest pain, shortness of breath, weight loss and abdominal pain are common symptoms of mesothelioma which has no cure and usually has fatal consequences.

Long Latency Period

Victims of asbestos related disease are often unaware of their condition in the early stages as in most cases the disease does not manifest itself until many years after exposure. If you have mesothelioma or asbestosis you may be able to claim compensation from the manufacturer of the material or from a previous employer. It is important to note that a UK compensation claim must be made within three years of a positive diagnosis.

Employers Liability

The dangers of asbestos have been known for more than a century and the failure of an employer to provide a safe and healthy work environment may be grounds for a successful compensation claim. If you have been diagnosed with mesothelioma or asbestosis and you believe it may be a result of your employer’s negligence you may have a god claim
